Do I need a lawyer?

While it is predictable that we would say "yes", there are many sound reasons to support that recommendation:

  • You have nothing to lose and everything to gain by discussing your case with Hayes Law. There is no cost or obligation with the initial consultation. And, there is no legal fee unless there is a financial recovery in your favor.
  • The Insurance Council's own study* in 1999 showed that there is a significant difference in the amount of the verdict or settlement in favor of the client who is represented by counsel.
  • The insurance company is not your friend, not even your own insurance company. Making mistakes early in the legal process can badly damage your ability to get the financial recovery you deserve.
    • For example, providing a recorded or written statement by you to the insurance company prior to talking to Hayes Law could affect your claim. Hayes Law can give you the guidance you need to avoid needless mistakes.
  • Hayes Law is your best chance for the financial recovery you deserve.

What if I'm not certain I have a case?

That is one of the most important reasons why you need an attorney. Our attorneys at Hayes Law Firm can help you determine if you have a claim worth pursuing. There is no cost to discuss and determine this issue.

There are many factors to examine such as what evidence there is of the other party's negligence or wrongdoing, what do the relevant insurance policies actually provide and other important criteria. At all times, it is your decision whether to proceed. Our attorneys are here to give you their advice and guide you through the process.

What do I do if I have been in an accident?

First, deal with all medical issues; don't tough it out and refuse treatment. You may jeopardize your health as well as your case.

Next, document the accident. Take photos of the scene, the cars and the property damage. Write down exactly how the accident occurred, complete with a street diagram. Make sure you get the name and phone number of any witnesses. Do not discuss the case with anyone except an attorney. Particularly avoid discussions with insurance adjusters or insurance investigators without first consulting with an attorney.

Does it make a difference who I hire?

Yes, it does. Some firms take every case that walks through the door. Hayes Law does not. Our practice is limited to personal injury. You would not hire a dentist to do your heart catheterization. Don't hire a family attorney to guide you through your personal injury claim.

We are very good at what we do which is obtaining the best possible financial recovery for you. Our lead attorney, Marcus Hayes, Sr., is a member of the Million Dollar Advocates Forum, which is limited to those attorneys in the United States who have secured million dollar verdicts or settlements in personal injury cases. While such a remarkable status does not guarantee similar results in your case, it certainly provides insight into the quality of this firm.

The insurance company adjuster is pressing me to make a statement or to accept a check right now, what do I do?

The insurance company is not your friend. Their job is to make their owners and/or shareholders happy through increased profits. You should not make any statements, sign any documents, allow the adjuster to record you in person or on the phone, or accept any check until you have discussed it with us. It is entirely possible that your actions could prejudice the real value and any additional recovery in your case. This is particularly true if there is any possibility your injuries could fail to heal as expected or become chronic. Your attorney at Hayes Law is the best person to evaluate your case, and give you the legal guidance you deserve. The insurance company is not your neighbor, nor on your side. Hayes Law is here for you and only serves you.

What if there is no insurance or there is just the minimum insurance?

Just because you have been told there is no liability insurance or only minimum limits does not mean there is not other coverage. Your personal injury lawyer at Hayes Law is the best person to guide you in determining if there are other sources of financial recovery. Also, the absence of specific insurance on the negligent auto does not mean that there is not other insurance coverage. There may be coverage through an employer, a relative or household member.

The same is true if the wrongdoer only has minimum insurance coverage. There may be other insurance that can be pursued or the wrongdoer may have other assets from which to seek recovery. Hayes Law can help you find all potential avenues of financial recovery.
